Deed, Noah Eltinge to Benjamin Deyo

This indenture made the third day of April in the seventh year of the reign of our Sovereign Lord George the third of the grace of god. Of Great Britain France and Ireland. King defender of the faith be and in the year of our lord Christ, one thousand seven hundred and sixty-seven Between Noah Eltinge of the precinct of the New Paltz in the county Of Ulster and province of New York (esquire) of his one part, and Benjamin Deyo of the same province of the New paltz aforesaid yeoman of this other part. Witnesseth that this said Noah Eltinge for and in consideration of the sum of forty five pounds current money of New York to him in hand paid by this said Benjamin Deyo at and before the sealing and delivery of the profit, the receipt whereof he doth herby acknowledge and himself therewith fully satisfied and there of and there from and of and from every part and parcel there of doth fully clearly and absolutely aquit, Promise, Release, Exonerate and Discharge the said Benjamin Deyo his Executors, Administrations and Assigns and every of them by these Presents. He tho said Noah Eltinge hath granted, bargained, Sold, Aliened Promised, Released and confirmed. And by these Present Doth fully, freely and Absolutely grant, Bargain, Sell, Alien, Promise, Release and Confirm unto the said Benjamin Deyo (In his Actual Possession now being by Virtue of a Bargain and Sale to him thereof made for one whole year, by Indenture bearing date the day next before the day of the Date of these presents, And by force of the statute for Transferring of Uses into Possession) And to his Heirs and Assigns for ever All That Contain Lot Piece or Parcel of land, Situate lying and being within the Limits and Bounds of the Patent of the New Paltz in Ulster County aforesaid, being Distinguished hed? known by the Lot Number four in the Lot Number Ten Called Grandfrere's Lot in the Second twelve Lots on North Division of the New Division of lots called the first Tier situate Eastward of the Old Divisions on the East Side of the Paltz River, and adjacent hereunto. The said lot number four containing by elimination thirty six acres more or less, Together with all and Singular Woods, Underwoods[sic], Trees, Timbers, Meadows, Marshes, Swamps, Ponds, Streams and Runs of water< Mines and Minerals and all other Profits, Privileges, Easements, Advantages, Hereditaments and Appurtnenances[sic] whatsoever to the said Lot Number four in the said Lot Number Ten belonging or in anyway Appertaining. And the Reversion and Reversions, Remainder and Remainders, Rents Dues and Profits thereof and of every Part and Parcel thenof[sic] with the Appurtenances[sic]; And also All the Estates, Rights, Title, Interest, Property, Possession, Claim and Demand whatsoever as well in Equity as in Law, of him the said Noah Eltinge of in and to all and singular the said Promises abovementioned and of, in and to every Part and Parcel thereof with the Appartenances[sic], To have and to hold all that the said Lot number four in the said Lot Number Ten And all and Singular the Hereditaments and Promisses[sic] abovementioned, and hereby Granted and Released[sic] and everypart[sic] and Parcel thereof with the appartenances[sic], unto him the said Benjamin Deyo, his heirs and Assigns forever, to the only Proper use ^(and behoof) of him the said Benjamin Deyo, his heirs and Assigns forEver[sic]. And he the said Noah Eltinge for himself, his Heirs and Assigns Doth Covonant[sic] and Grant to all with the said Benjamin Deyo, his heirs and Assigns, That he the said Noah Eltinge now is and Standeth[sic] Lawfully Seized of and in the above granted and Released[sic] Lane and Promises with the Appartenances[sic] of a good, Due, perfect, Absolute and Indefeasable[sic] Estate of Inheiritance[sic] in Head Simple, and now hath good Right, full Power, and lawful and Absolute Authority to Grant and Convey the same unto the said Benjamin Deyo and his Heirs and Assigns for ever, according to the Purport, true intent and meaning of these Presents; And That the Same now is and forever hereafter Shall Remain free and Clear and freely and Clearly discharged from all former and other Gifts, Grants, Bargains, Sales, Mortgages, Judgements, Dowers, Entails and all other incumbrances in the Law whatsoever; And the Same Land, Hereditaments and Promises with the Appartenances[sic], hereby Granted and [illegible 2 words] in the Quiet and Peaceful Posession[sic] of the said Benjamin Deyo, his Heirs and Assigns, Against him the said Noah Eltinge, his Heirs and Assigns, and Against all and every other Person and Persons whatsoever Lawfully Claiming on to Claim any Estate, Right, Title or Interest therein, Shall and will forever Warrant and Defend. In Witness whereof the said Noah Eltinge hath hereunto[sic] set his hand and Seal the Day and year first abovementioned[sic].
