before me James Tallmadge Jun Surrogate of the said Coun
ty Roger Southerland who on his oath declared that he did
see David Johnston sign and seal the annexed written In
strument purporting to be a codicil to the will of the said
David Johnston bearing date the second day of August one
thousand eight hundred and two and heard him publish
and declare the same as and for a Codicil to his last will
and testament That at the same time thereof he the said Da
vid Johnston was of sound disposing mind and memory
to the best of the knowledge and belief of him the depo
nent and that this deponent John Potter and Lewis
Northrup severally subscribed the will [strikethrough] ^codicil as witnesses thereto
ni [sic] the testators presence; James Tallmadge Junior Surrogate.
Whereas In and by my last will and testament hereunto
annexed bearing date the 21st day of December in the year
of our Lord 1799 I have among other bequests given devised
and bequeathed to my daughter Cornelia then the widow of
Gulian Ver Planck deceased a certain part or portion of my
estate both real and personal and whereas since the execution
of my said will the said Cornelia has imprudently married
Now to secure the said property so given devised and bequeath
ed as aforesaid to the children of my said daughter by the
said Gulian Verplanck I do hereby revoke the said devise and
bequest to the said Cornelia And so hereby give devise and
bequeath to Maria Eliza Sophia David Johnston Emily
and Charlotte the Children of the said Cornelia by the
said Gulian Verplanck their heirs and assigns forever the said
part or proportion of my estate so ni [sic] my said last will
and testament given devised and bequeathed to my said
daughter Cornelia subject nevertheless to the Conditions of
the said will And I do hereby declareit to be my will and
